Dear Traveller(s),

These are the Terms and Conditions that will apply to your booking. Please read them carefully as Nusadinusa and you will be bound by them. By booking a trip, you agree to be these Terms and Conditions will regulate your tour booking, price and payment, changes and cancellation policy and limitations of liability.

1. The Booking

Our website serves as a guide to our tours, but the information on the website does not necessarily pertain to your Booking. The Booking is based on a detailed offer that Nusadinusa sends to you. If you accept this offer we will finalize the reservations and the Booking becomes definite from the date that Nusadinusa sends a Booking Invoice in an email, to the address that you have provided; together with a detailed description of the Booked tour and services. The person or persons named on the booking are hereafter referred to as the ‘Traveller(s)’. All exchange of information will be done with one person only, referred to hereafter as the Booker.

2. Required Information

Pertaining to the Traveller(s) The Booker needs to provide the following details once an offer from Nusadinusa has been accepted. This is required in order for Nusadinusa to make an accurate and correct Booking. Details required for each Traveller include: passport number, passport expiry date, passport issue date and place of issuance, full name as it appears in the passport you are travelling with, date of birth, place of birth, nationality and arrival details. A Booking cannot be confirmed without the provision of these details. The Traveller(s) is responsible for obtaining a Visa to enter Indonesia. Nusadinusa will provide information regarding Visa requirements, but cannot be held responsible if the Traveller is denied entry into Indonesia.

It is advisable that the Traveller(s), as much as is possible, acquaint themselves with the culture, customs and climate of the area in which the tour takes place.

3. Price, Currency and Payment

The price for the tour will be stated in the Booking Invoice that you receive by email. Based on this, payment should be made within one week, in the currency (or the agreed equivalent currency) quoted in the Booking. In cases where the booking is made more than six weeks prior to the start of the tour, you are required to make a down payment of 20% of the total sum plus 100% of any local air fares which may be part of your package. The required amount of the down payment will be stated in your Booking Invoice. The remainder should be paid no later than 30 days before the start of your tour. Bookings made within six weeks of the start of your tour should be paid in full within 7 days of receipt of the Booking Invoice.

4. Cancellation and/or Alteration of the Tour by the Traveller(s)

Any cancellation or alteration requested by a Traveller(s) must be made in writing by the Booker to Nusadinusa. The cancellation or alteration only goes into effect after acknowledgement by Nusadinusa in writing by return email. The date on which the request to cancel is received by Nusadinusa will determine the cancellation fees that are applicable.

In the case of cancellation more than 30 days prior to the start of the tour, the cancellation fee will be equal to the down payment. If the cancellation takes place within 30 days of the start of the tour, the cancellation fee will be equal to the total stated in the Booking Invoice. In this case, twenty percent of the cancellation fee will be held in deposit by Nusadinusa for a period of five years should the Traveller(s) wish to make a new booking at a later time. The deposit will be deducted from the cost of the new booking.

In the case of an alteration of the Booking, including for example, changes of the tour start date, substitution of a Traveller(s), cancelling part of tour, etc., Nusadinusa may charge a cancellation fee, but will try to minimize the cost of said alteration. In the case where a part of the tour is not utilised by the Traveller(s) due to circumstances beyond the control and responsibility of Nusadinusa, no refunds will be given.

5. Alteration and/or Cancellation of the Tour by Nusadinusa

The Traveller(s) understands and acknowledges that due to the nature of the destination and in some circumstances, Nusadinusa may have to make reasonable alterations to the tour itinerary. It is understood that routes, schedules, amenities and modes of transport may be subject to change without prior notice when due to unforeseeable circumstance outside the control of Nusadinusa.

In the case of major alterations or cancellation of the tour, Nusadinusa will notify the Traveller(s) as quickly as possible and will contact the Traveller(s) with options for the changes or the cancelled tour.

In case of an alteration or cancellation to part of the tour due to unforeseeable circumstances outside the control of Nusadinusa, Nusadinusa will do their utmost to offer an alternative or reimburse the Traveller(s) as much as is possible to do so.

6. Insurance and Limitation of Liability

The Traveller(s) is very strongly advised to obtain adequate travel insurance with sufficient medical coverage while travelling in Indonesia with Nusadinusa. This insurance should cover personal injury and emergency medical expenses. The Traveller(s) should provide a copy of the Insurance policy by email or upon the start of the tour.

The Booker must notify Nusadinusa in writing during the process of booking of any health or medical conditions (including physical, mental, a disability or otherwise) that could have an impact on their ability to fully participate in that tour or on the ability of Nusadinusa to execute that tour properly.

Nusadinusa shall not be liable in any way for the Traveller(s) in the case of: death, bodily injury, illness, damage, delay or other loss to that person or their property, or for any financial costs incurred that should be covered by proper travel insurance. Nusadinusa shall not be liable in any way or for any costs associated with any circumstances that are beyond the control and responsibility of Nusadinusa, such as terrorist attacks, fire, extreme weather or other natural or man-made calamities.

7. Complaints and Claims

The Traveller(s) will be provided with an emergency mobile number for Nusadinusa as well as the regular office numbers and email addresses. If the Traveller(s) is not satisfied with the tour (or part thereof) as described in the Booking Invoice, the Traveller should contact Nusadinusa as soon as possible during the tour by phone or e-mail, so that a suitable resolution can be instigated. Nusadinusa will confirm the problem and a solution with the Traveller as soon as possible. If a problem cannot be resolved in a satisfactory manner at the time of the tour, the Traveller should put the complaint in writing within 30 days after the end of the tour. Nusadinusa will respond to this complaint within 30 days and if it deems fit, will offer compensation. No compensation can be offered if the problem was not reported by the Traveller(s) during the tour. In case the Traveller(s) is not satisfied with the compensation that is offered, a legal complaint can be made to the Court of Law in Denpasar, Bali as these Terms and Conditions are subject to the exclusive jurisdiction of the Republic of Indonesia.
